Abstract

The inter-ministerial decree n. 150 of April 7, 2020 declared Italian ports «unsafe» for ships flying foreign flags and for the entire duration of the health emergency due to Covid-19 outbreak. The reason for this late legislative measure lies in the request by the German ship Alan Kurdi to land in Lampedusa with 150 rescued migrants. The decree, which is an administrative act of secondary rank, contradicts norms and principles of constitutional value; its necessity and proportionality are also doubtful. Section 2 of this contribution examines the domestic implications of the decree, i.e. its consequences on some constitutional rights, the duty to rescue people at sea and the legal form chosen for the intervention. In Section 3, attention will shift to the even more problematic profile of its effects on the right to asylum and the principle of non-refoulement.
