Abstract
Explains, using hypothetical case scenarios involving neighbouring couples who took identical local authority tenancies in 1975, how the different legal rules applicable depending on whether succession to the tenancies was by the death of one party, or as a result of divorce, mean that in 2015 the daughter of one family was a tenant and the other a trespasser. Discusses the scope for challenging such unequal treatment under ECHR art.14.
