Abstract

The decision in Biogen v Medeva was handed down by the House of Lords on the night of Halloween 1996, more than 20 years ago. The case is a landmark one because it was the first time the House of Lords considered genetic engineering in the context of patent law. Every student of UK patent law still studies the case, often in great detail. Consequently, in exams it is not uncommon for students to be asked to discuss the legacy of Lord Hoffmann's statement on 'Biogen insufficiency' in the context of earlier cases like Genentech (1989) and later cases such as Generics v Lundbeck (2009).
