Abstract
There are many longstanding links between the EU and China but they have not been embedded legally in any meaningful way beyond dialogues at least until more recent times. China has long had a complex esoteric place as to EU procurement, EU foreign direct investment and EU international fisheries policies, where its exclusion appears as a central goal of EU actions, policies and practices or where double-standards routinely operate. The advent of a Cross-Border Data Flow Communication Mechanism in the midst of ongoing tariff strife shows the importance of China as a data and trade actor to the EU and the need for deeper and wider cooperation. From a data flow perspective, irrespective of the political status quo, many key issues appear to unfold, where data trumps values and other ideals the law and politics thereof demonstrates.
